Introduction

These Terms of Service ("Terms") govern your use of the EvoMone® mobile wallet application ("Service"). By downloading or using EvoMone®, you agree to be bound by these Terms.

EvoMone® is operated by EvoMone Ltd, a company registered in England and Wales. These Terms are governed by the laws of England and Wales.

The Service — Regulatory Compliance

EvoMone® is a non-custodial Bitcoin and Lightning Network wallet. EvoMone® does not provide financial advice or promote the purchase of Bitcoin. Any decision to buy, sell, or hold Bitcoin is entirely at the discretion of the user.

Bitcoin-related services such as fiat on/off-ramps are provided by independent third-party partners, including MoonPay. Those partners are solely responsible for regulatory compliance within their own services, including any requirements under the UK Financial Promotions Regime.

EvoMone® does not store, manage, or exchange user funds. We are not responsible for any decisions made by users to engage with third-party services available through the app.

Wallet, Lightning Network & Fees

3.1 Transactions and Fees

The Breez SDK may incur base network and service fees, typically 0.1% to 0.25% plus miner fees. These are charged by the underlying network and service and are not controlled by EvoMone®. In addition, EvoMone® charges a 0.5% service fee per transaction.

All applicable fees are shown clearly before you confirm any transaction. There are no hidden charges.

3.2 Lightning Network and Breez SDK

EvoMone® uses the open-source Breez SDK (via Nodeless) to enable Lightning Network payments. This SDK may include fallback routing mechanisms, for example via Liquid, depending on payment conditions, wallet state, and network availability.

As Lightning is a decentralised protocol, EvoMone® is not responsible for routing failures, liquidity issues, or failures caused by third-party Lightning nodes.

EvoMone® does not store, manage, or retain custody of user funds at any point.

3.3 Cloud Backup

If you choose to enable cloud backup, your recovery phrase is encrypted locally on your device using AES-256, with keys stored in iOS Keychain or Android Keystore, before being backed up to iCloud or Google Drive. While encrypted, no cloud service can be considered entirely risk-free.

Important: Cloud backup is recommended only for testing or small amounts. You remain solely responsible for securing your 12-word recovery phrase. EvoMone® cannot recover lost wallets or private keys under any circumstances.

Messaging & User Content

EvoMone® includes encrypted messaging. Messages are encrypted in transit and stored securely on our servers. Full end-to-end encryption is planned for a future update.

Users are fully responsible for any messages or media they send through the app. Abuse of the messaging feature, including spam, harassment, or transmission of illegal content, may result in suspension or permanent termination of access to messaging features.

Third-Party Services

MoonPay

EvoMone® integrates with MoonPay, an independent third-party provider, for fiat currency transactions. EvoMone® is not liable for any delays, verification issues, or transaction failures involving MoonPay.

All disputes related to fiat transactions must be directed to MoonPay directly. Users must accept MoonPay's separate terms and conditions before accessing their services.

No Financial Advice

EvoMone® does not provide financial, investment, or trading advice. Use of the app is entirely at your own risk. Cryptocurrency markets are volatile and unregulated in many jurisdictions.

EvoMone® does not promote, recommend, or provide financial advice on any third-party services. Any interaction with providers such as MoonPay is entirely at the user's own discretion.

User Responsibilities

By using EvoMone®, you accept the following responsibilities:

  • You are solely responsible for managing your private keys and 12-word recovery phrase. EvoMone® cannot recover lost wallets or private keys.
  • You must comply with all local laws applicable to your use of EvoMone®, including any laws relating to cryptocurrency in your jurisdiction.
  • You must comply with MoonPay's policies when using fiat on/off-ramp features.
  • You are responsible for ensuring your account is not accessed by unauthorised parties.

Prohibited Activities

The following activities are strictly prohibited when using EvoMone®:

  • Using EvoMone® for any illegal activity, including fraud, money laundering, or terrorist financing.
  • Interfering with, reverse-engineering, or attempting to circumvent any part of the app or its third-party integrations.
  • Transmitting spam, malware, or any harmful content through the messaging features.
  • Impersonating EvoMone® or any third-party service within the app.

Data Privacy & Messaging

Your EvoMone® messaging account is linked to a hashed phone number and a secure identifier. Messages are stored on EvoMone®’s servers in encrypted form. EvoMone® cannot read or access message content.

Your contacts within EvoMone® are stored on our secure servers to enable messaging and contact management features. We do not access or share your contact list with third parties.

Age Eligibility

The EvoMone® wallet app is available to download for users of all ages. However, fiat services provided by MoonPay are restricted to users aged 18 and above in most jurisdictions.

EvoMone® does not verify user age directly but cannot enable access to MoonPay's services for users who do not meet MoonPay's eligibility requirements.

Limitation of Liability

To the maximum extent permitted by law, EvoMone Ltd's total aggregate liability for any claims arising out of or related to the use of the Service shall be limited to £100 per calendar year.

This limitation applies whether the claim arises from contract, negligence, or any other legal theory. This clause is designed to protect our ability to continue operating sustainably while offering an accessible service.

EvoMone® is a non-custodial wallet. We do not hold your funds at any point. Any losses arising from user management of private keys, recovery phrases, or third-party service interactions are outside the scope of EvoMone Ltd's liability.

Brand & Intellectual Property

The EvoMone® name, logo, and slogan ("We Are The Currency") are proprietary assets of EvoMone Ltd. EvoMone® is a formally registered trademark, and these elements are protected under applicable intellectual property laws.

You may not copy, modify, or reuse EvoMone® branding, app content, or visual assets without prior written permission from EvoMone Ltd.

Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales.

In the event of any dispute arising from the use of EvoMone®, you agree to first attempt resolution through informal negotiation. If unresolved, the dispute will be referred to the courts of England and Wales.

Changes to These Terms

EvoMone® may update these Terms at any time. We will notify users of material changes via the app or by email where reasonably practicable. Continued use of the Service after updates have been published constitutes your acceptance of the revised Terms.
